Iran: Suspicious Death of Imprisoned Protester Javad Rouhi Raises Alarming Questions

Mazadanran Province, Iran – The recent death of Javad Rouhi, a 31-year-old Iranian protester, while in custody has sparked widespread concern and raised serious questions about the treatment of detainees and the transparency of the Iranian legal system. Rouhi, who was arrested during the widespread protests that erupted in Iran in September 2022, was horrifically tortured and sentenced to death after an unfair trial. His death under suspicious circumstances and a lack of information surrounding the investigation have prompted calls for an international inquiry.

A Disturbing Pattern of Abuse

Rouhi’s death is a tragic reminder of the continued human rights abuses perpetrated by the Iranian government. His case is just one in a long list of individuals who have suffered from torture and mistreatment while in custody. Amnesty International has documented at least 72 deaths in Iranian prisons since 2010, with 46 of those cases attributed to torture or ill-treatment by intelligence and security agents or prison officials.

Rouhi’s experience in detention was particularly harrowing. He was held in solitary confinement for over 40 days without any communication with his family. During this time, he was subjected to extreme physical and psychological abuse, including exposure to freezing temperatures, beatings with batons, and the placement of ice cubes on his body for extended periods. As a result of the torture, Rouhi suffered from severe physical and mental impairments, including a concussion and a loss of bowel control and mobility.

A Flawed Trial and Lack of Accountability

The trial proceedings against Rouhi were marred by numerous violations of due process rights and fair trial standards. He was sentenced to death by Branch 1 of the revolutionary court in Sari city in Mazandaran province after a trial that lasted only 45 minutes. The court refused to consider reports of Rouhi’s torture and denied him access to a lawyer of his choice. It was only after his lawyer appealed the decision that his death sentence was struck down and a retrial was ordered by the Supreme Court.

Despite these egregious violations, Iranian authorities have consistently failed to conduct transparent investigations into suspicious deaths in custody. They have also avoided holding any official accountable for these human rights abuses. The United Nations Principles on the Effective Prevention and Investigation of Extra-Legal, Arbitrary, and Summary Executions clearly call for thorough and impartial investigations into all suspicious deaths in custody, as well as providing families and their legal representatives access to relevant information.

International Call for an Inquiry

The Independent International Fact-Finding Mission on the Islamic Republic of Iran, established by the UN Human Rights Council in September 2022 to investigate human rights violations related to the protests, must take immediate action to investigate Rouhi’s death in custody. Furthermore, an international inquiry is necessary to ensure an independent and transparent investigation into his case.

Tara Sepehri Far, senior Iran researcher at Human Rights Watch, rightly emphasizes the need for the fact-finding mission to investigate all instances of torture and deaths in custody related to the protests. The case of Javad Rouhi is only the latest in a series of human rights violations that demand attention and action.

The Way Forward

The international community must place pressure on the Iranian government to uphold human rights standards and ensure accountability for those responsible for the torture and mistreatment of detainees. Governments, human rights organizations, and individuals can contribute by supporting the work of organizations like Human Rights Watch and Amnesty International, which strive to document and expose human rights abuses. Additionally, diplomatic efforts and economic sanctions can be used to send a strong message to the Iranian government that human rights violations will not be tolerated.

The harrowing story of Javad Rouhi’s death in custody serves as a stark reminder of the urgent need for action and accountability in Iran. The international community must not turn a blind eye to these human rights abuses and must stand together in demanding justice for Rouhi and all those who have suffered under the Iranian government’s oppressive regime.
