Israel/Palestine: Devastating Civilian Toll as Parties Flout Legal Obligations

Introduction

The ongoing conflict between Israel and Palestine has once again resulted in a devastating civilian toll. Human Rights Watch has reported that Palestinian armed groups launched a deadly assault that killed several hundred Israeli civilians on October 7, 2023. In response, Israeli counterstrikes led to the deaths of hundreds of Palestinians. As of October 8, the attacks by Palestinian armed groups had killed more than 677 Israelis and foreign nationals, including civilians, according to Israeli sources cited by the United Nations. Subsequent Israeli airstrikes on Gaza resulted in at least 413 Palestinians dead, as reported by the Palestinian Health Ministry in Gaza.

Civilian Casualties and War Crimes

The deliberate targeting of civilians, indiscriminate attacks, and the taking of civilians as hostages by Palestinian armed groups amount to war crimes under international humanitarian law. These actions have no justification and are heinous crimes that should be condemned. The same can be said for the Israeli authorities’ cutting off of electricity to Gaza and other punitive measures against the civilian population, which amount to unlawful collective punishment and also constitute a war crime.

Both parties involved in the conflict must be held accountable for their actions. The laws of war apply to all parties, regardless of the lawfulness of going to war or imbalances of power. In recent years, Palestinians in the Occupied Palestinian Territory (OPT) have faced unprecedented levels of repression by Israeli authorities. The number of Palestinians being held in administrative detention without charges or trial has reached a 30-year high, and the unlawful closure of Gaza has entered its 17th year.

Crimes Against Humanity

The Israeli government’s systematic oppression in the OPT, coupled with inhumane acts committed against Palestinians to maintain the domination of Jewish Israelis over Palestinians, have been classified by Human Rights Watch as crimes against humanity. These acts amount to apartheid and persecution, and they must be addressed by the international community.

During prior rounds of hostilities, Human Rights Watch has documented serious violations of the laws of war by both Israeli forces and Palestinian armed groups. Israel has repeatedly carried out indiscriminate airstrikes, resulting in the deaths of scores of civilians and the destruction of civilian infrastructure. Palestinian armed groups have also launched thousands of indiscriminate rockets, violating the laws of war and committing war crimes.

International Criminal Court Investigation

The current fighting once again highlights the urgent need for justice. The International Criminal Court (ICC) prosecutor, Fatou Bensouda, opened a formal investigation into serious crimes committed in Palestine in 2021. It is crucial that the ICC accelerate its investigation and hold all parties accountable for their actions. Impunity for serious abuses only perpetuates further repression and shedding of civilian blood.

Conclusion

The conflict between Israel and Palestine has resulted in a devastating civilian toll, with both parties flouting their legal obligations. It is essential that international law and human rights norms be respected and upheld by all parties involved. The international community must prioritize justice and accountability to end the cycle of violence and ensure the protection of civilian lives. Only through a commitment to human rights and the rule of law can a just and lasting resolution to the Israeli-Palestinian conflict be achieved.
