“Justice Delayed in Mali: Calls for Accountability in Moura Massacre Mount”

The UN report on the Moura massacre in Mali is a grave reminder of the continued violations of human rights in war-torn countries and the need for accountability. The report documents the summary execution of at least 500 civilians by the Malian army and its foreign allies during an operation in the village of Moura, in March 2022. It further reveals that 58 women and girls were sexually violated by Malian military personnel. The atrocities committed in Moura are heinous and unacceptable. Amnesty International urges the Malian authorities to undertake independent and impartial judicial proceedings in the ordinary law courts regarding the crimes committed and ensure accountability for the perpetrators.

## International Humanitarian Law

Under International Humanitarian Law, all the parties to the conflict in Mali have an obligation to comply with the provisions of the law. The Malian army and its allies as well as armed groups must respect the fundamental principles of distinction, proportionality, and military necessity. Civilians must be protected against attacks, and the use of lethal force in any operation must be a last resort. The presence of armed group members in a town does not authorize a military to violate the rights and freedoms of the civilian population. Therefore, summary executions and sexual violence are crimes under international law and unacceptable in any situation.

## The Need for Accountability

The lack of accountability for crimes committed during the conflict in Mali is a significant concern. Almost all the ongoing proceedings concerning the abuses committed by soldiers during the conflict have stalled, making no progress. The military courts have jurisdiction to try crimes against civilians, which is in violation of international and regional human rights protection standards. Therefore, Amnesty International calls on the Malian authorities to conduct in-depth and independent judicial investigations into the incidents in Moura and all other atrocities committed during the conflict. The International Criminal Court, which has an ongoing investigation into the Mali situation, needs to pay attention to the events in Moura, which saw the biggest civilian death toll since the conflict began in 2012.

## Conclusion

The events in Moura are a tragic reminder of the suffering of civilians in war-torn regions. The Malian authorities must take prompt action to ensure accountability for the perpetrators and provide justice to the victims. The international community, including the UN and the International Criminal Court, must support and assist in the process. The atrocities committed in Moura must not go unpunished, and efforts must be made to prevent such crimes from occurring in the future. The people of Mali, especially those residing in the conflict-affected regions, demand justice, peace, and security, and it’s the responsibility of the authorities to deliver.
