The Latest Attack on Trans Rights: Russia’s Proposed Ban on Trans Health Care

Russian Proposal to Ban Gender-Affirming Health Services for Transgender People

A new proposal by elected officials in Russia seeks to prohibit transgender individuals from accessing gender-affirming health care services, including voluntary surgeries. The draft law would also allow doctors to carry out medically unnecessary operations on intersex children without their consent. Furthermore, the proposed legislation prevents individuals from changing their names and gender markers on official documents, and this violates the privacy and physical integrity rights of intersex children and consenting transgender adults.

Discriminatory and Hypocritical Legislation

The Russian proposal is discriminatory and hypocritical as it caters to the interests of politicians rather than human rights. It violates the fundamental rights of both transgender individuals and intersex children, uses regressive rhetoric to justify oppressive measures, and operates against the informed consent rights of patients.

Transgender adults have the right to access gender-affirming health services to foster their well-being and self-identification. Meanwhile, intersex children have the right to bodily integrity and autonomy, which means that doctors should not subject them to medically unnecessary operations. Rather than acknowledging these rights and allowing individuals to make informed choices about their bodies, legislators are seeking to impose rigid, oppressive norms that violate basic rights.

The Global Trend of Anti-LGBTQ+ Legislation

The Russian proposal is not an isolated case, as other countries have proposed similar anti-LGBTQ+ legislation. For example, American state governments have introduced dozens of bills that limit gender-affirming care for transgender people while allowing non-consensual interventions on intersex children. Intersex people are usually described in this legislation as “children with a medically-verifiable disorder of sex development,” a pejorative term for intersex variations.

In Russia, the deputy behind the recent bill, Petr Tolstoy, said that the bill aims to preserve “cultural and family values.” Putin’s support for the bill is consistent with his known rejection of universal human rights, and his government has further extended the reach of Russia’s “gay propaganda” law, which outlaws the public portrayal of non-traditional sexual relations.

Conclusion: Upholding Human Rights for All

The rights of transgender individuals and intersex children must be protected and upheld. Rather than imposing rigid norms on how individuals identify and express themselves, legislators must acknowledge the importance of informed consent, choice, and autonomy. Human rights are universal, and legislation must be informed by these principles to provide a better future for everyone.
