Russia’s Sham Trial of Ukrainian Prisoners of War: A Grave Violation of Humanitarian Law
An Overview
In June, Russia’s Southern District Military Court in Rostov-on-Don initiated criminal proceedings against 13 men and 9 women from the Ukrainian “Azov” Brigade. The defendants face charges under Russia’s criminal code, including alleged actions aimed at overthrowing Russia-backed authorities in Ukraine’s Donetska region in the spring of 2022 and involvement in the activities of a “terrorist organization.” Some defendants are also accused of receiving training for carrying out terrorist activities.
The Azov Brigade, a formation of Ukraine’s National Guard, is part of the Armed Forces of Ukraine. Headquartered in Mariupol, the brigade played a crucial role in defending the city against Russia’s full-scale invasion in February 2022. After being besieged for 80 days at the Azovstal Iron and Steel Works, around 2,000 Ukrainian soldiers surrendered in May 2022. In August of the same year, the Russian government designated the Azov Brigade a “terrorist organization.”
Violation of Prisoner of War Status
Most of the defendants standing trial in Rostov are members of the Ukrainian Armed Forces, which grants them prisoner-of-war (POW) status. According to the Third Geneva Convention on the Treatment of Prisoners of War, POWs are entitled to certain protections and cannot be prosecuted for offenses committed before their capture, provided these offenses were not considered crimes at the time and place they were allegedly committed. Consequently, Russia lacks the legal basis to prosecute the captured Ukrainian soldiers for their membership in the Azov Brigade while they were deployed in Ukraine.
Evidence of Ill-Treatment and Inhumane Conditions
During a court hearing on June 28, at least three defendants testified that they had experienced ill-treatment while in detention in the Russia-controlled area of Donetska region and had been coerced into signing confessions. Two defendants reported a significant deterioration in their health. Photographs from the courtroom hearing show the defendants looking exhausted and gaunt. It is evident that the charges being brought against them are merely a pretext to persecute Ukrainian soldiers for their role in defending Mariupol from the Russian assault.
Breaches of the Geneva Conventions and War Crimes
Prosecuting prisoners of war for their participation in a conflict, denying them fair trial rights, and subjecting them to torture or inhuman treatment constitute flagrant violations of the Geneva Conventions and are clear war crimes. The international community must recognize and condemn these violations, holding Russia accountable for its actions.

The ongoing trial of Ukrainian soldiers from the Azov Brigade serves as yet another example of the Kremlin‘s propaganda machinery at work. By designating the Azov Brigade as a “terrorist organization” and prosecuting its members, Russia is attempting to not only discredit Ukraine but also delegitimize any resistance to its aggression.
The Kremlin‘s strategy hinges on portraying Ukraine as a hotbed of extremism and terrorism, thereby justifying its invasion and continued interference in the country’s affairs. By targeting the Azov Brigade, a unit that played a crucial role in defending Mariupol, Russia is attempting to erase the heroism and sacrifices of Ukrainian soldiers and undermine the legitimacy of Ukraine’s resistance against the invasion.
It is essential for the international community to recognize this propaganda for what it is and to reject Russia’s attempts to distort the truth. The war in Ukraine is not a conflict between terrorists and a legitimate government but rather a result of Russia’s unwarranted aggression and illegal annexation of Crimea.
The Way Forward: Protecting Humanitarian Law and Ensuring Justice
International Pressure and Accountability
The international community must respond swiftly and decisively to Russia’s sham trial of Ukrainian prisoners of war. The first step is to exert diplomatic and political pressure on Russia to immediately drop all charges against the Azov defendants and release them. Countries that uphold the principles of international law and human rights should condemn Russia’s actions and consider imposing targeted sanctions on individuals involved in these violations.
Humanitarian Assistance and Accountability Mechanisms
Furthermore, support should be provided to the Ukrainian government in ensuring the well-being and fair treatment of Ukrainian prisoners of war. Humanitarian organizations should be given access to provide necessary medical care and monitor the conditions under which the prisoners are held.
Additionally, an independent international mechanism should be established to investigate and document the war crimes committed by Russia during the invasion of Ukraine. This mechanism should hold accountable those responsible for violations of international humanitarian law, ensuring that justice is served and that such actions are not repeated in the future.
Defending the Principles of Justice
It is imperative that the principles of justice and the rule of law are upheld in the face of Russia’s blatant disregard for international norms. The sham trial of Ukrainian prisoners of war is not just an attack on the Azov Brigade but an affront to the integrity of the Geneva Conventions and the pursuit of justice in armed conflicts. The international community must stand united in defense of these principles and ensure that those responsible for war crimes are held accountable.
