Three Years After Beirut Blast, Calls for Justice Persist

Background

As Lebanon mourns the three-year anniversary of the catastrophic explosion in Beirut’s port, calls for justice and accountability are intensifying. The blast, which occurred on August 4, 2020, claimed the lives of at least 235 people and caused extensive damage to more than half of the city. Despite the passage of three years, no one has been held responsible for the tragedy.

The domestic investigation into the Beirut Blast came to a halt in December 2021 due to legal challenges filed against lead investigator Judge Tarek Bitar and other judges involved in the case. These challenges were filed by politicians who feared becoming targets of the investigation. When Judge Bitar attempted to resume the investigation in January 2023, he faced further obstruction, including a lawsuit and a travel ban imposed by Public Prosecutor Ghassan Oweidat, who himself had been charged in connection with the port investigation. Oweidat also ordered the release of detained individuals suspected of involvement in the explosion, and at least one defendant has since fled the country.

The actions of Public Prosecutor Oweidat have been widely condemned by the Beirut Bar Association and the Lebanese Judges Association, both of which have deemed them illegal. Meanwhile, the investigation remains suspended, leaving survivors, victims’ families, and civil society groups disillusioned.

A Culture of Impunity

Amnesty International’s Deputy Director for the Middle East and North Africa, Aya Majzoub, has criticized the Lebanese authorities for their failure to hold anyone accountable for the Beirut Blast. Majzoub emphasizes the authorities’ use of various tactics to undermine and obstruct the domestic investigation, thereby perpetuating a culture of impunity in the country. She argues that these actions not only shield those responsible for the catastrophe but also erode public trust in the justice system.

This culture of impunity is a deeply rooted issue in Lebanon. The country has a history of political interference and corruption, which has hindered the functioning of institutions and eroded the rule of law. The Beirut Blast serves as a tragic reminder of these systemic failures and the devastating consequences they can have.

International Criticism

The international community has also condemned the Lebanese authorities’ interference in the domestic investigation. In a joint statement delivered at the United Nations Human Rights Council in March 2023, 38 states, including Australia, expressed concern about the obstruction, interference, intimidation, and political impasse hindering the investigation. The statement called on Lebanon to uphold its international human rights obligations, safeguard the independence of the judiciary, and ensure a swift, independent, impartial, credible, and transparent investigation.

The Quest for Justice and Truth

As Lebanon continues to grapple with the aftermath of the Beirut Blast, the quest for justice and truth remains a critical priority. The survivors, victims’ families, and civil society groups are once again appealing to the United Nations Human Rights Council to establish an international fact-finding mission to investigate the causes of the explosion and identify those responsible for the catastrophe.

An international fact-finding mission could help overcome the political impasse and ensure an impartial investigation. It would demonstrate the commitment of the international community to the pursuit of justice and hold the Lebanese authorities accountable for their failure to act. Furthermore, such a mission would provide an opportunity for survivors and victims’ families to have their voices heard and their trauma acknowledged.

Reparation and Healing

Justice is not only about holding individuals accountable; it also encompasses the need for reparation and healing. The survivors and victims’ families have endured immense pain and suffering, both physically and emotionally. The unresolved trauma resulting from the Beirut Blast continues to haunt countless lives.

Any comprehensive justice process should include provisions for reparations to ensure that the victims receive the support they need to rebuild their lives. This can take various forms, including financial compensation, medical and psychological assistance, and measures to address the broader societal impact of the explosion. It is crucial for the international community to support Lebanon in providing these reparations and facilitating the healing process.

Three years after the devastating explosion in Beirut’s port, the pursuit of justice remains elusive. The domestic investigation has been marred by political interference and obstruction, perpetuating a culture of impunity in Lebanon.
