An Important Step Forward for LGBTI Rights in Hong Kong

In response to the Hong Kong Court of Final Appeal’s recent verdict granting a partial victory to LGBTI activist Jimmy Sham, Amnesty International’s Regional Director for East, Southeast Asia and the Pacific, Piya Muqit, has hailed this decision as a crucial step forward in the fight for equal rights for the LGBTI community in Hong Kong. Since 2018, Sham has been campaigning for the recognition of his overseas same-sex marriage, challenging the outdated and discriminatory laws that have denied equality to LGBTI individuals in the city for far too long.

While the ruling can be seen as a moment of hope, it is important to recognize that it falls short of complete equality. The Court’s decision still affirms that the constitutional right to marry is exclusively confined to opposite-sex couples, which is regrettable. However, the Court does acknowledge the government’s duty to provide same-sex couples with formal and general legal recognition in order to protect their rights, enable them to participate in social life with certainty, and recognize their legitimacy.

A Call for Urgent Reform

With this landmark ruling, the Hong Kong government is now faced with the urgent need to reform its laws on same-sex marriage. The Court’s demand for the adoption of a legal framework for recognition is a clear indication that the discriminatory laws must be changed. The government must not delay in implementing this ruling as the first step towards ensuring full equality for the LGBTI community.

Furthermore, the ruling adds to the government’s existing to-do list, which includes legislating laws on gender recognition and fighting discrimination based on sexual orientation, gender identity, or intersex status. These issues have seen minimal progress in the past decade despite public consultations. It is imperative that the government takes immediate action to address these issues and create a society that treats all individuals equally, regardless of their sexual orientation, gender identity, or intersex status.

The Legitimacy of Jimmy Sham’s Marriage

The Court’s ruling brings into question the legitimacy of Jimmy Sham’s same-sex marriage, which was conducted in the United States in 2013. Amnesty International firmly asserts that Sham’s marriage is legitimate and should be recognized as such. Today’s verdict must serve as a springboard for the Hong Kong authorities to end discrimination based on individuals’ identities and love. All laws, policies, and practices that discriminate against individuals based on their sexual orientation, gender identity, and intersex status must be thoroughly reviewed and overhauled.

The Road to Equality

While this ruling represents a significant step forward, there is still a long road ahead in the pursuit of full equality for the LGBTI community in Hong Kong. The Court’s decision emphasizes the need for a comprehensive review and revision of existing laws and policies in order to ensure equal treatment for all individuals, regardless of their sexual orientation, gender identity, or intersex status. It is essential that Hong Kong embraces a more inclusive and progressive society, where all marriages are treated equally and discrimination is eradicated.

In recent years, the Court of Final Appeal and lower courts in Hong Kong have recognized the discriminatory nature of denying partnership rights to same-sex couples in various contexts. This includes accepting the rights of same-sex couples to receive spousal dependent visas, employment benefits, joint tax assessments, and public housing. Amnesty International firmly believes that same-sex relationships should be recognized equally and granted the same rights as opposite-sex couples.
