Countries Should Back ICC Investigation on Israel–Palestine: Important Opportunity to Speak Up for Justice
The ongoing hostilities between Israel and Palestinian armed groups have resulted in horrific crimes with devastating consequences for civilians. The lack of accountability for past abuses has only exacerbated the current violations, which continue to escalate. In this context, it is disheartening to see that governments around the world have largely remained silent about the role of the International Criminal Court (ICC) in delivering impartial justice.
The Role of the ICC
The ICC is the only international entity currently tasked with investigating and prosecuting serious crimes on a global scale. While not all countries are members of the ICC, the State of Palestine is, and the ICC prosecutor’s office has been investigating alleged crimes in the region since 2021. The recent report by the United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territory has provided clear evidence of war crimes in both Israel and Gaza, and has signaled its intention to share this information with relevant judicial authorities, particularly the ICC.
However, the response from ICC member countries has been disappointing. As of now, only Liechtenstein, Switzerland, and South Africa have made clear statements referring to the ICC and the current hostilities. Even more concerning is the fact that the ICC prosecutor has not proactively issued a public statement reminding Israel and Palestinian armed groups of their obligations under international law and the court’s mandate to investigate their actions. This absence of a strong and consistent voice from the ICC jeopardizes the prevention of further atrocities and perpetuates double standards in victims’ access to justice.
Double Standards in International Response
Comparing the response to the Israel–Palestine conflict with other crises, such as the conflict in Ukraine, reveals a clear double standard. When Russia invaded Ukraine in 2022, the ICC prosecutor spoke out about the court’s critical role, and numerous European ICC member countries called for an investigation. Even the United States, a non-ICC member, expressed strong support for the ICC‘s involvement. The disparity in international support and recognition of the ICC‘s role is concerning and raises questions about the politicization of justice and accountability.
An Important Opportunity to Speak Up for Justice
On October 26, following a US veto of a UN Security Council resolution, the UN General Assembly will hold an emergency special session to address the ongoing hostilities. This presents a crucial moment for countries to raise their voices in support of justice and the ICC‘s role in investigating war crimes in Israel and Palestine. It is imperative that all ICC member countries use this opportunity to unequivocally stand up for impartial accountability and condemn the continued violation of international law.
A Call for Urgent Support
The role of the ICC in ensuring justice cannot be understated. The absence of accountability for past abuses perpetuates a cycle of violence and a disregard for international human rights and humanitarian law. By supporting the ICC‘s investigation in Israel and Palestine, countries can send a strong message that impunity will not be tolerated and that all parties to the conflict must be held accountable for their actions.
The international community has a moral obligation to uphold the principles of justice and human rights. It is time for governments around the world to speak up, back the ICC investigation, and work towards a just and lasting resolution to the Israel–Palestine conflict.
