Opinion: Latest De Lima Acquittal Exposes the Politicization of Philippines’ Justice System

The recent acquittal of former Senator Leila de Lima from the second of three drug cases against her highlights the political nature of charges brought against her and the sad state of the Philippine justice system. Her likely continued custody in police detention brings to the fore how the justice system has been manipulated against her through accusations that have been dubbed as politically motivated. De Lima has been in detention for over six years, and her situation has generated international attention. The cases against her were purportedly fabricated, and it is unlikely that the third case against her has more credibility.

The Duterte administration’s improper influence over the Department of Justice is evident by the recanting of the testimony of three key witnesses in this case, saying they had been coerced. The charges were filed against de Lima in retaliation for her efforts to investigate the killings that occurred during President Rodrigo Duterte’s “war on drugs” in 2016. Duterte has been a critic of de Lima since the late 2000s, when she began an investigation into killings attributed to a “death squad” in Davao City, where Duterte was the mayor, while she served as the chair of the Commission on Human Rights.

The International Criminal Court (ICC) is investigating numerous “drug war” killings that occurred during Duterte’s presidency. To avoid international justice, Duterte withdrew the Philippines from the Rome Statute in 2019, which obligates states party to the treaty to cooperate with the court.

De Lima’s latest acquittal brings hope that her unjust detention may be ending sooner rather than later, but the Philippine Department of Justice needs to drop the remaining case against her to regain some of its credibility. The justice system’s politicization must end, and there is a need for accountability. President Ferdinand Marcos Jr. should urgently launch an inquiry into how the levers of the justice system were manipulated against de Lima and implement reforms to ensure such politicization of the justice system never happens again.

The manipulation of the justice system is a reflection of the erosion of the rule of law in the country. It is crucial for the Philippines to ensure that the justice system remains fair and impartial. This is essential to protect the rights of all citizens, regardless of their political affiliations. Many feel a sense of unease, knowing that justice is unlikely to be served if they ever find themselves wrongly accused of crimes in the Philippines.

The De Lima case is a symptom of the country’s larger political and human rights concerns. The targeting of government critics and human rights defenders as well as the lack of accountability for summary killings, torture, and arbitrary detention is a major concern to the international community. President Biden should use his upcoming meeting with President Marcos to press for reforms and demand accountability for human rights abuses and the politicization of the justice system.

In conclusion, the De Lima case has exposed the politicization of the justice system in the Philippines, and there is an urgent need for reforms to ensure that justice is not compromised for political gain. It is essential for the government to hold itself accountable and implement measures such as launching an inquiry to avoid similar cases in the future. Without these steps, the Philippines‘ human rights crisis will continue to spiral out of control.
