Amnesty International Condemns Inadequate Investigation into Death of Palestinian Activist Nizar Banat

Lack of Accountability and Impartiality

Amnesty International has released a scathing report criticizing Palestinian authorities for their failure to effectively investigate the death of activist Nizar Banat. Banat, a prominent critic of the Palestinian authorities, died in custody two years ago after being arrested and beaten by Palestinian security forces. Despite 14 officers being charged in relation to his arrest, Amnesty International argues that the trial has been marred by delays and lacks impartiality.

According to the report, the ongoing trial scheduled before a military court in Ramallah has made a “mockery of impartiality and fairness.” Amnesty International states that the trial should be referred to a civilian court in order to ensure transparency and impartiality. The organization further highlights the authorities’ failure to question or investigate any senior officers, focusing solely on low-ranking officers. This raises serious concerns about the integrity of the investigation and the sincerity of the authorities’ commitment to justice.

Harassment and Intimidation of Banat’s Family

Amnesty International also sheds light on the harassment faced by Nizar Banat’s family members as a result of their pursuit of justice. Several outspoken family members have been arbitrarily detained or dismissed from government jobs. As a party to key international human rights treaties, including the International Covenant on Civil and Political Rights and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment and Punishment, the State of Palestine has a legal obligation to conduct a prompt, impartial, and independent investigation into Nizar Banat’s arrest and killing. Amnesty International urges the authorities to hold all those responsible for these unlawful actions accountable, including those who ordered his arrest.

Amnesty International stresses the importance of fair trials in civilian courts for anyone reasonably suspected of responsibility, emphasizing that the death penalty should not be an option. The organization underscores that impunity cannot be condoned and calls on the international community to exert pressure on the Palestinian authorities to uphold their obligations and ensure justice for Nizar Banat.
