Russia: Trans Health Care, Families Bill Violates Rights Intensifying Assault on LGBT Rights

Introduction

On July 14, 2023, Russia‘s lower house of parliament passed a bill that severely violates the rights of transgender people, according to Human Rights Watch. The bill, which is expected to be approved by the upper chamber and President Vladimir Putin, outlaws trans healthcare, dissolves marriages of transgender individuals, bans changing gender markers in official documents, and prevents trans people from adopting or becoming guardians of children. This legislation is the latest attack on the rights of LGBT individuals, and it ought to be dropped immediately.

The Violations of Trans Rights

The bill proposed by Russia‘s lower house of parliament not only bans medical interventions integral to internationally recognized standards of care for transgender individuals, such as gender-affirming medication and surgery, but it also allows for medically unnecessary, nonconsensual surgeries on intersex children. Such procedures carry significant risks and should be safely deferred. These provisions not only discriminate against transgender people but also violate their rights to physical integrity and privacy.

In addition, the bill prohibits transgender individuals from adopting or becoming foster parents, effectively denying them the right to form families and depriving children of loving homes. Existing marriages of transgender people would automatically be dissolved. The fact that Russian courts have previously annulled transgender people’s marriages based on lawsuits from prosecutors highlights a persistent and hostile response to the rights of LGBT individuals.

A State-Driven Transphobia

This bill is part of a broader crackdown on LGBT people in Russia. In December 2022, legislation was passed that expanded the ban on sharing positive or neutral information about LGBT people, including gender transition. Activists protesting against the law were detained and prosecuted by the police. Furthermore, in September 2022, a court in Saint Petersburg declared that social media posts “creating an appearance that [being transgender] is socially acceptable” were illegal.

The adoption of this new bill further highlights the Russian government’s deliberate targeting of transgender individuals. By erasing transgender identities from public view and now implementing a range of laws that directly harm transgender people, Russia is perpetuating a systematic attack on the rights and lives of LGBT citizens.

Ethical Concerns and Medical Professionals’ Warnings

During the first reading of the bill, Pyotr Tolstoy, the State Duma’s deputy chair, defended the legislation as a step to protect national interests from “perversions.” However, his dismissive stance towards the concerns raised by the Health Ministry and the scientific community is deeply troubling. The adoption of this bill risks exacerbating ethical, medical, and social problems, including an increased risk of suicides among transgender individuals.

Philosophical Discussion: The Fight for LGBT Rights

This assault on transgender rights in Russia raises profound philosophical questions about the struggle for LGBT rights worldwide. At its core, this issue is about respect for human dignity and the belief that every individual, regardless of their gender identity or sexual orientation, should enjoy the same rights and protections as their cisgender and heterosexual counterparts.

However, as we have seen in Russia and many other parts of the world, achieving equality for LGBT individuals remains a challenge. Steps towards progress are met with resistance and backlash from politicians, religious institutions, and segments of society that cling to outdated notions of “traditional values.”

In the case of Russia, it is not simply a matter of opposing progress or clinging to traditional values; it is a deliberate campaign to marginalize and discriminate against LGBT individuals. Using the guise of protecting national interests, the government is actively erasing their identities, denying them healthcare, and preventing them from forming families.

Editorial: Reversing the Anti-Trans Law

Russia‘s assault on transgender rights should not be tolerated by the international community. It is incumbent upon governments, NGOs, and individuals to speak out against this violation of human rights. The Russian government must reverse its outrageous policies and ensure the rights to identity, family life, and medical care for all LGBT individuals, starting with the immediate abandonment of the anti-trans law.

Conclusion and Advice

The fight for LGBT rights in Russia is far from over. It requires sustained international pressure, advocacy, and support for local activists and organizations. Governments around the world should use diplomatic channels and sanctions, if necessary, to demonstrate that the persecution of LGBT individuals is unacceptable and will not be tolerated.

Furthermore, individuals outside of Russia can also make a difference by staying informed about the situation, amplifying the voices of LGBT activists, and supporting organizations working on the ground. By standing in solidarity with the LGBT community in Russia and other countries facing similar challenges, we can contribute to the global fight for equality and human rights.
