Laws of War Protect Those Who Can’t, Don’t Flee

Introduction

In the ongoing conflict between Israel and Palestine, grave concerns have arisen for the safety and well-being of civilians as Israel began major ground operations in the Gaza Strip on October 28, 2023. The previous Israeli ground operation in Gaza in 2014 witnessed numerous violations of the laws of war, including the deliberate targeting of civilians, which amounted to war crimes. Unfortunately, these violations were never prosecuted. Palestinian armed groups also committed war crimes by deliberately launching rocket attacks towards Israeli communities in 2014. It is crucial to highlight that all civilians, including those who cannot or do not want to leave their homes in northern Gaza, retain their protections under the laws of war.

The Current Situation

The major ground offensive by Israel has come after weeks of bombardment that have left significant parts of neighborhoods in ruins. This offensive has sparked serious concerns for the safety of all civilians caught in the crossfire. Thousands of children and other innocent civilians have already lost their lives in this conflict. Additionally, Palestinian armed groups continue to indiscriminately launch rockets at Israeli communities.

The Laws of War

It is important to remember that even in times of conflict, all individuals, especially civilians, are protected by the laws of war. These laws prohibit deliberate, indiscriminate, or disproportionate attacks on civilians. This means that all parties involved in the conflict are obligated to distinguish between combatants and civilians and take precautionary measures to prevent harm to innocent lives.

War Crimes and Violations

The violations committed by Israeli forces during the 2014 ground operation, including the deliberate killing of civilians, constituted war crimes. However, to this date, no prosecutions have taken place for these grave violations of international law. Similarly, Palestinian armed groups’ deliberate rocket attacks on Israeli communities also constitute war crimes. It is crucial that all parties involved be held accountable for their actions.

Protecting Innocent Lives

In the face of escalating violence and mounting civilian casualties, it is imperative that all parties involved prioritize the protection of innocent lives. Israel must abide by the laws of war and take every possible measure to minimize harm to civilians during its military operations. Palestinian armed groups, on the other hand, must cease the indiscriminate launch of rockets towards Israeli communities.

International Engagement and Accountability

The international community, including neighboring countries and global powers, has a significant role to play in preventing further loss of innocent lives. It is crucial that countries back an investigation by the International Criminal Court (ICC) to ensure accountability for all parties involved in the conflict. By supporting the ICC investigation, the international community can send a clear message that violations of the laws of war and war crimes will not be tolerated.
