Ukraine’s LGBT Center: Attacked and Defiant

## Attack on Ukrainian LGBT Center Highlights Urgent Need for LGBT Protection Legislation

On June 13, 2023, the office of Insight, an LGBT organization in Lutsk, Ukraine, was broken into and vandalized. The incident not only underscores the ongoing vulnerability and harassment faced by Ukraine‘s LGBT community but also raises urgent questions about the lack of adequate legal protections in the country.

Insight is a vital lifeline for lesbian, gay, bisexual, and transgender Ukrainians, serving as a hub for humanitarian activity since Russia’s full-scale invasion of Ukraine. The organization provides essential services such as medical care, legal aid, and psychosocial support to queer community members. It has also played a pivotal role in providing emergency housing and distributing aid parcels during this challenging period.

This recent attack is not an isolated incident. LGBT human rights defenders associated with Insight have long been targeted for their work. In 2022, Insight chair Olena Shevchenko was teargassed while delivering humanitarian aid in Lviv. This attack followed previous instances of violence, including a far-right attack on the Equality Festival in Lviv in 2016, teargassing of LGBT defenders at Kyiv Pride in 2018, and physical assault on Shevchenko in 2019.

Unfortunately, the response from authorities to these incidents has been inadequate. Last year’s attack on Shevchenko was not properly investigated, with the police failing to inform her of the forensic examination results or collect her victim statement. Despite these glaring failures, the authorities continue to neglect their responsibility to protect LGBT human rights defenders.

The Ukrainian government must take swift action to ensure a thorough and transparent investigation into the recent break-in and damage to Insight’s office. This investigation should involve active consultation with LGBT activists and human rights defenders, who possess critical knowledge and insights about the ongoing threats they face. It is essential that the authorities address the pattern of abuse and harassment against LGBT defenders, both in this specific case and in general.

However, it is crucial to recognize that a comprehensive legislative framework is needed to combat discrimination and protect the rights of Ukraine‘s LGBT community. The absence of legislation specifically outlawing discrimination based on sexual orientation, gender identity, and gender expression leaves the community highly vulnerable. It also perpetuates a climate in which hate crimes and attacks on LGBT organizations go unpunished or inadequately addressed.

Enacting comprehensive legislation that explicitly protects individuals from discrimination based on their sexual orientation and gender identity is an urgent necessity for Ukraine. Such legislation would not only serve as a deterrent against hate crimes but would also provide the LGBT community with a sense of security and acknowledgment. Additionally, it would demonstrate the government’s commitment to upholding human rights and fostering inclusivity.

In conclusion, the recent attack on Insight’s office is a distressing reminder of the ongoing challenges faced by Ukraine‘s LGBT community. It is imperative that the Ukrainian authorities conduct a thorough investigation into this incident and take proactive steps to ensure the safety and protection of LGBT human rights defenders. However, these isolated efforts must be accompanied by the enactment of comprehensive legislation that guarantees equal rights and protection for the entire LGBT community. Only then can Ukraine truly aspire to be a country that upholds human rights and fosters an inclusive society for all its citizens.
