Unlawful Attack in Ukraine Raises Concerns of War Crime

Russian Missile Strike Hits Residential Area

An unlawful attack took place in Ukraine on July 6, 2023, when a Russian cruise missile struck a residential apartment complex in Lviv, a city in western Ukraine. The attack violated the laws of war and resulted in the death of 10 civilians, as well as 48 injuries. While there were Ukrainian military targets in the vicinity, the targeting of a residential area filled with sleeping civilians should be thoroughly investigated as a possible war crime, according to Human Rights Watch.

Evidence Points to Indiscriminate Attack

During the attack, Russian forces used guided munitions, specifically Kalibr cruise missiles, which have the capability of accurately delivering a large, high-explosive warhead to targets over long distances. The attack on the apartment complex, which contained approximately 500 residents, was consistent with the effects of such a missile.

Eyewitness accounts and satellite imagery revealed that there were two additional missile strikes, most likely targeting military objectives. However, the blast waves from the detonations caused damage to many residential buildings in the neighborhood. Human Rights Watch verified the damage through interviews with local authorities, military officials, and residents, as well as through the analysis of videos, photographs, and satellite imagery.

Tetiana, a resident of the targeted apartment complex, described seeing a rocket flying from the direction of a nearby park before the explosion. Nataliya Sokyrchuk and her family took shelter in their bathroom when the air raid siren awakened them, but a subsequent explosion blew out the windows of their living room. Another resident, Ihor Ivanov, was injured when the explosion destroyed his room, leaving broken glass and dust everywhere. Unfortunately, Olha Dudka, one of Sokyrchuk’s neighbors, did not survive the attack.

The damage caused by the blast waves extended beyond the targeted residential complex, impacting other nearby apartment buildings as well. Cars parked in the vicinity also sustained damage.

Possible Violation of International Humanitarian Law

The laws of war applicable to the international armed conflict in Ukraine prohibit deliberate attacks on civilians and civilian structures, as well as attacks that fail to discriminate between combatants and civilians. Indiscriminate attacks, which include bombardments that treat multiple military objectives as a single target in a civilian-populated area, are also prohibited. While Ukraine is obligated to avoid locating military targets in densely populated areas, Russian forces are required to take feasible precautions to minimize civilian casualties and damage to civilian objects.

The use of guided munitions by Russian forces raises concerns that the attack on the residential complex was deliberate and unlawfully indiscriminate. These actions must be thoroughly investigated to determine if a war crime has occurred.

The international community, through the United Nations or other multilateral platforms, should play an active role in facilitating dialogue and promoting a lasting peace agreement.

Lastly, efforts to hold perpetrators of war crimes accountable must be pursued vigorously. The pursuit of justice is essential not only to ensure accountability but also to deter future violations. The establishment of an international tribunal to address war crimes committed during the conflict in Ukraine could serve as a step forward in achieving justice and preventing future atrocities.
